As the debate surrounding the filling of seats in the Parliament of Barbados continues, there has been a new development.

Former Attorney General in the Freundel Stuart administration, Adriel Brathwaite, instructed his lawyers to file an application under a certificate of urgency in the High Court that as he puts it, “seeks declaratory reliefs aimed at compelling this government to put its house in order before conducting the affairs of state”.

In a statement released after the filing, Mr Brathwaite stressed that while Parliament has been convened, it is purporting to conduct business at a time when the Senate has not been constituted in accordance with the clear, unambiguous mandate of Section 36 of the Constitution. He added, only 18 of the required 21 Senators have been appointed, and says this means that we do not have a Senate and without a senate, we do not have a Parliament.

In response, Attorney General Dale Marshall said he is confident the government’s position is sound, and the Senate is properly constituted.

The Attorney General says he eagerly awaits seeing the documents and as a matter of principle, he welcomes all challenges.
