The hearing challenging the constitutionality of Parliament is to resume on Friday when the legal team representing the Attorney General, Dale Marshall, Q.C. will present arguments before Madame Justice Cicely Chase.
The focus yesterday was the role of the President in naming Senators.
Queen’s Counsel Garth Patterson, who is representing former Attorney General Adriel Brathwaite, Q.C. advanced his team’s argument on a number of grounds, including that the wording of the Constitution made it mandatory for all 21 seats in the Upper Chamber to be filled, rather than a maximum number or a minimum number.
Mr. Patterson further argued the language in Section 36 of the Constitution compels the President to name a full slate of Senators.
