Bar Association wants commission of enquiry

October 4, 2023

The Barbados Bar Association is calling for a commission of enquiry or an independent investigation into the discovery of a cellphone in the room of a police station, where an attorney had been meeting with a client.

The Association made the appeal during a press conference, following the conclusion of an investigation by police into the February 4th incident.

A letter from the Office of the Police Commissioner last month, indicated the investigation had not established any breaches in the protocol of client’s rights or attorney-client consultation privileges.

Convenor of the Bar Association’s Criminal Law Committee Martie Garnes, however suggests the matter is of public importance and requires further action.

The Bar Association has also taken issue with the investigation’s conclusion the phone was “unserviceable”.

Meanwhile, the attorney at the centre of the incident has suggested it would be virtually impossible for any civilian, including lawyers and suspects, to have placed the phone in the room without being seen.

According to Faith Greaves, the room in question has about 20 feet of transparent glass on either side of it with corridors running adjacent to the glass.

She’s encouraged the public to consider who would have the opportunity and time to affix the phone under the desk.

Ms. Greaves says they are currently exploring all legal options with respect to the incident.

Her client’s matter is still before the court.
