The National Union of Public Workers was given 48 hours to respond to a letter served by the attorneys representing suspended President Akanni McDowall or face court action.
A letter from Clarke, Gittens and Farmer, dated July 6th and signed by R. Omari Drakes, is addressed to Acting General Secretary Wayne Walrond and makes four main demands in relation to the suspension of McDowall and his inability to submit his candidacy for president.
The letter says that the National Council of the NUPW acted in breach of the rules and laws of natural justice because their client was never given any opportunity to be heard by the Council or have a meeting on the charges brought against him.
The four demands being made of the National Council are:- for the immediate withdrawal of the suspension; that everyone be communicated the withdrawal of said suspension; thirdly that the period for submission of a member’s candidacy be extended by two weeks and the elections be delayed; and finally that the Union agrees to indemnify McDowall with respect to costs which he has incurred in the matter.
The letter further states that if there is no response, the appropriate injunctive action will be applied
The letter was copied to the Registrar of the Supreme Court.
Under the Constitution of the Union, any one being charged is to be given the chance to be heard by the National Council and also have a chance to appeal said charges as provided in Rule 10 (G) of the Constitution.
